Terms of service

Last updated

These terms apply to the use of Enlist, provided by Mike Hagen Eggertsen, a private individual in Denmark with no CVR number, Peder Hjorts Vej 7, 2500 Valby, Denmark ("Enlist", "we"). "You" is the person or business that creates an Enlist account. If you create the account for a business, you accept these terms on its behalf and confirm you are allowed to.

Accepting these terms

By creating an account or using Enlist, you accept these terms and the data processing agreement. The data processing agreement governs the personal data in your waitlists, and forms part of these terms. There is nothing to sign.

The service

Enlist is waitlist infrastructure: an API, a TypeScript SDK, an MCP server and a dashboard for collecting signups, assigning positions, sending signup emails, tracking their delivery and forwarding events to tools you connect. We keep developing the service and may change features. We tell you about significant changes in advance.

Your account

  • You sign in with GitHub. Keep that account secure, as access to it is access to Enlist.
  • Keep your API keys secret and on your server. Anyone holding a key can do what its scopes allow. Revoke a key in the dashboard if it may have leaked.
  • You are responsible for what happens under your account and keys.

Plans and payment

  • The free plan costs nothing. Paid plans, their prices and limits are shown on the pricing page.
  • Paid plans are billed in advance, monthly or yearly, through our payment provider Stripe, and renew automatically until you cancel.
  • You can cancel or change plan at any time in the billing portal. When you cancel, you keep the paid plan until the end of the period you have paid for. Fees already paid are not refunded for a part period, with two exceptions: if you end the agreement because you object to a new sub-processor, or if Enlist ends the service, Enlist refunds fees paid for the time after the end.
  • Nothing is metered. When you reach a plan limit, Enlist stops accepting what is over the limit (for example new signups, or email sent on Enlist's account) and asks you to upgrade. We never bill for overage.
  • If a payment fails, Stripe retries it. If the subscription ends unpaid, the account returns to the free plan's limits. Your signups are not deleted.
  • We give at least 30 days' notice of a price increase for an existing subscription. The new price applies from your next renewal after that notice.

Your data

You own the data in your waitlists. For the personal data in them, you are the controller and Enlist is your processor, as described in the data processing agreement. We never sell the data and do not use it for anything other than providing Enlist to you.

You can export a waitlist as CSV at any time, on every plan, through the API or the dashboard.

Your responsibilities towards signups

You decide whom you add to a waitlist and what you send them, so you are responsible for:

  • having a legal basis for collecting each signup and for the emails sent to them, and telling them who you are and how you use their data;
  • handling their requests to see, correct or delete their data. Enlist gives you the tools: look up a signup by email, export a waitlist as CSV, and delete a signup through the API, the SDK or the MCP server;
  • the tools you connect (webhooks, Slack, Discord, Loops, Kit, PostHog or your own email provider). Data you send there is under your agreement with that provider;
  • not storing national identification numbers, health data or other special categories of personal data (Article 9 GDPR), or data about criminal offences, in custom fields or metadata.

Acceptable use

Do not use Enlist:

  • to send spam or email to people who have not asked to hear from you;
  • for unlawful content, or content that infringes the rights of others;
  • to probe, overload or work around the limits and security of the service, or to access other people's data;
  • in a way that puts the service or other customers at risk.

We may suspend an account that breaks these rules. Where we can, we tell you first and give you the chance to fix it.

Availability

We work to keep Enlist stable and secure, but we do not promise that it is always available or free of errors, and there is no service level agreement. Keep your own copy of lists that matter to you by exporting them.

Liability

  • We are only liable for direct losses you suffer because of errors or omissions on our part.
  • We are not liable for indirect losses, such as lost profit, lost signups, lost revenue or third-party claims.
  • Our total liability to you is limited to DKK 5,000 per calendar year.
  • These limits do not apply if we have acted intentionally or with gross negligence, and they do not limit the right of data subjects to compensation under Article 82 GDPR.

Ending

You can stop using Enlist and delete your account in Settings at any time. Deleting the account deletes your waitlists and signups at once, and cancels any subscription.

We give at least 30 days' notice by email before we stop providing the service to you, unless you have broken these terms seriously. Personal data is then deleted as described in the data processing agreement.

Changes to these terms

If we change these terms or the data processing agreement significantly, we email you at least 30 days before the changes take effect. If you do not want the new terms, you can delete your account before they take effect. If you keep using Enlist after that date, the new terms apply.

Governing law

These terms are governed by Danish law. Disputes are settled by the Danish courts.
